What you should know

The fee for a statement of claim in property cases depends on the value of the claim (WPS). Up to PLN 20,000 fixed fees apply in seven brackets (from PLN 30 to PLN 1,000). Above PLN 20,000 a proportional fee of 5% of the claim value is charged, capped at PLN 100,000. The fee is rounded up to the nearest złoty.

The value of the claim is, as a rule, the amount of the principal claim — excluding interest, profits and costs claimed alongside it (Articles 19–26 of the Polish Code of Civil Procedure). The same table also applies to, among others, appeals, objections to default judgments and charges against payment orders.

Legal basis

Articles 13 and 21 of the Act of 28 July 2005 on Court Costs in Civil Cases. The cap on the proportional fee was reduced from PLN 200,000 to PLN 100,000 by an amendment effective from 23 September 2025.

Frequently asked questions

What is the value of the claim (WPS)?

It is the value of the principal claim stated in the lawsuit — excluding interest, profits and costs if they are claimed alongside the principal claim. The rules for determining it are set out in Articles 19–26 of the Polish Code of Civil Procedure.

Can the filing fee be lower?

Yes. In electronic writ-of-payment proceedings (EPU) one quarter of the fee is charged. A party in financial hardship may apply for an exemption from court costs, and in some cases part of the fee is refunded — for example when the dispute ends in a settlement.

What is the maximum filing fee?

In property cases the proportional fee is 5% of the value of the claim, but no more than PLN 100,000. This cap has applied since 23 September 2025 — previously it was PLN 200,000.
